Terms of Use — Shato Tours
Shato Tours (hereinafter “Shato Tours”, “we”, “us”, “our”) welcomes you (the “User(s)”, “you”) to our website at shato.tours and related online services (the “Site”). The Site provides information about our company and enables booking of travel-related services (the “Services”, see below). By using the Site, you agree to the terms set out below.
1. Acceptance of the Terms
By entering, connecting to, accessing, or using the Site, you acknowledge that you have read and understood these Terms—including our Privacy Policy and Cookie Policy (together, the “Terms”)—and agree to be bound by them and to comply with applicable laws and regulations. If you do not agree, do not use the Site and/or the Services.
The Site is available to individuals aged 18+ who have the capacity to enter into legally binding agreements. If you use the Services on behalf of a third party, you confirm that such party has been informed of and agrees to these Terms.
2. The Site and the Services
Shato Tours provides an online platform for booking travel services and/or products: day tours, private and group transfers, vehicle rentals via partners, lodging reservations, and more (collectively, the “Travel Services”).
The Site may include: company information, partner information, news, tour descriptions, prices and date calendars, contact details, text, images, logos, videos, data compilations, UI elements, and other items (the “Content”). We may also offer newsletter subscriptions (“Newsletter Subscription”).
Important: some Content may be provided by third parties (descriptions, prices, special offers, etc.). Such content is not always verified by us and does not constitute our binding commitment; in case of inconsistencies, information obtained directly from the relevant service provider prevails.
3. Bookings
You can make online bookings for Travel Services (including tours, activities, tickets, lodging, etc.) via the Site. After completing the booking process (a “Booking”), you must pay the stated amount; then you will receive booking confirmation by e-mail.
Bookings may be fulfilled by our in-house operations teams or by licensed local operators/partners (each, an “Operator”). Operator contact details will be provided upon confirmation.
Because we rely on partner information, certain Bookings may be cancelled, modified, or rescheduled for reasons beyond our control (force majeure, security directives, weather, site closures, etc.). In such cases, we will try to notify you in advance and propose reasonable alternatives (e.g., substituting a location). We also reserve the right to provide a comparable service via a different supplier than initially indicated.
During holidays and special dates (regional/religious), some tours may be unavailable; we may optimize the itinerary for best outcomes.
All communications about a Booking (updates, rescheduling, cancellation requests) are handled via Shato Tours unless we direct you to the relevant Operator. Quality claims should be submitted within a reasonable time after service delivery (unless a specific service/law sets otherwise) and addressed to Shato Tours or the relevant Operator.
Transportation. Services are performed using vehicles of various types and capacities. We strive to ensure vehicles comply with local laws. Special requests (wheelchairs/child seats/dietary needs, etc.) are available upon prior notice and subject to third-party availability.
4. User Responsibilities
4.1. Punctuality. Arrive at the pickup point at least 15 minutes before departure. Drivers are not obliged to wait for latecomers. If you are late, the tour may proceed without you—no refund for missed portions.
4.2. Group tours. Do not separate from the group. In exceptional cases, “search/escort” actions may incur a special fee at the Operator’s discretion and at the participant’s expense.
4.3. Connectivity. We recommend a charged mobile phone capable of receiving/making calls; provide your contact when booking. Roaming/data charges are at your expense.
4.4. Conduct and safety. We/the Operator may remove a participant from a tour without compensation in cases of aggressive/abusive conduct, threats, failure to follow guide instructions, creating risks to self/others, wilful property damage, or materially disrupting the group’s pace.
4.5. Insurance and belongings. We recommend comprehensive travel insurance. Shato Tours and/or the Operator are not responsible for loss/theft of personal belongings.
4.6. Itinerary check. Review your dates and services; if anything is incorrect, contact us immediately.
4.7. Law and respect. Follow local/international rules and respect staff, fellow travellers, and local communities. Services may be terminated without refund for violations, and incidents may be reported to competent authorities.
5. Waiver and Photo/Video Consent
During tours, the Operator/guides/drivers may take photos/videos for promotional or news purposes in compliance with applicable privacy law. If you do not agree, notify our representative in advance. By giving consent, you authorize the use of such materials without compensation and release Shato Tours and contractors from claims relating to their lawful use.
6. Cancellations and Refunds
6.1. Shato Tours commercial rules. Governed by our separate Cancellation Policy document (“Shato Tours — Cancellation Policy”). In short: cancel no later than 48 hours before departure for a full refund; within 48 hours and in case of no-show/same-day cancellation—100% charge.
6.2. Statutory rights. Statutory consumer rights under the laws of the State of Israel (including distance-selling rules and cancellation periods with minimal fees) apply in addition; in case of conflict, the broader rights granted by law prevail.
7. Fees and Payments
Payments are processed via authorized payment service providers (acquirers/PSPs). The list of providers may change. We do not control their platforms and are not responsible for their actions; you must comply with their terms.
Border-crossing tours (Jordan/Egypt, etc.). Mandatory border/visa/port fees listed in the tour description may apply. These are typically paid in cash at the border. Fee amounts are set by the competent authorities and may change; we inform you as information becomes available. After entering a foreign country, parts of the tour may be operated by a local partner acting as the Operator for that segment.
The Operator may, at its discretion, change the order of visits/days in multi-day programs and lodging locations without a refund basis, provided the program’s value is preserved.
8. Use Restrictions
Prohibited, among other things: unlawful/unauthorized use of the Site/Content; commercial use without consent; removal of proprietary notices; collection of personal data without consent; interference with the Site/networks; false affiliation with Shato Tours; excessive load on infrastructure; circumvention of access controls; decompilation, reverse engineering, or creation of derivative works from the Content; framing/inline-linking without consent; distribution of malicious code; and any other violation of these Terms and/or the law.
9. Minors
The Site is intended for users aged 18 and older. We may request age verification and remove data/block access if a minor user is identified.
10. Contacting Us via the Site
You may contact us via the Site’s contact form, as well as by phone, e-mail, SMS, WhatsApp, and our official social media accounts. To process your inquiry, provide your name, e-mail, phone number, and message text.
11. Registration and Account
Certain features may require an account. One active account per user is allowed. Keep your password confidential, keep your details up to date, and promptly notify us of any unauthorized access. We are not responsible for losses resulting from failure to follow these rules. Deleting your account may result in data loss—for which we are not responsible.
12. Privacy Policy and Cookie Policy
We respect your privacy. Details are provided in Shato Tours’ Privacy Policy and Cookie Policy, published on the Site and incorporated herein by reference. By using the Site/providing third-party data, you confirm such parties have been informed and, where required by law, have given consent.
13. Intellectual Property Rights
The Site, the Content, and other IP (patents, applications, trademarks, copyrights, domain names, trade secrets, etc.), whether registered or not, are owned by Shato Tours and/or its licensors and protected by law. These Terms grant you no rights other than a limited, revocable right to use the Site in accordance with the Terms. Feedback/suggestions may be used by Shato Tours on a royalty-free, irrevocable, worldwide basis.
14. Trademarks and Trade Names
Marks of Shato Tours and third parties are used on the Site. No rights to such designations are granted; you agree not to use them without the rightsholder’s consent.
15. Links to Our Site and Third-Party Links
We welcome hyperlinks to any page on the Site provided the link is not misleading as to endorsement/sponsorship by Shato Tours and does not harm our reputation. Framing/inline-linking—only with our prior written permission.
Third-party links are provided for convenience. We do not control external sites/services, their availability, content, or privacy practices and accept no responsibility for them. Use at your own risk.
16. Social Features
The Site may include sharing tools (e.g., “Share”, “Like”) integrated with third-party social networks. Their use is governed by the relevant platform rules; if you disagree, disable the integration (functionality may be affected). We are not responsible for actions of such platforms.
17. Advertising, Promotions, Sponsorships and Benefits
Third-party materials and benefits may appear on the Site. We do not guarantee their accuracy/availability and may receive compensation for such placements; you are not entitled to any share of such compensation. Advertisers are responsible for their advertising information.
18. Availability of the Site
The Site’s operation depends on many factors (communications networks, etc.). We do not guarantee uninterrupted, error-free, or unauthorized-access-proof operation of the Site.
19. Changes to the Site
We may, at any time and without notice, modify/improve/suspend/terminate the Site (in whole or in part) and update/remove Content and functionality.
20. Disclaimers
To the maximum extent permitted by law, the Site and the Content are provided “as is”, “as available”, and “with all faults”. We and our affiliates, employees, directors, contractors, and agents make no express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, continuity or error-free operation, correction of defects, absence of malicious code, or achievement of expected results. Your use of the Site is at your own risk.
21. Limitation of Liability
To the maximum extent permitted by law, Shato Tours, the Operators, and related parties are not liable for any damages (direct, indirect, special, punitive, incidental, lost profits, data loss, etc.) arising from or related to the use/inability to use the Site/Services/Content/participation in tours, regardless of the legal theory and even if advised of the possibility of such damages.
In any case, Shato Tours’ aggregate liability to you is limited to the amount actually paid by you to Shato Tours for use of the Site/specific service.
22. Indemnification
You agree to defend, indemnify, and hold harmless Shato Tours and related parties from claims, losses, and expenses (including reasonable attorneys’ fees) arising from: your use/misuse of the Site/Services/Content; your breach of these Terms; your infringement of third-party rights (IP/privacy); or any harm to third parties in connection with the Site/Services/Booking. We may assume the defense in any matter; this does not relieve your obligations.
23. Amendments to the Terms
We may update these Terms from time to time. Material changes will be posted prominently on the Site 7 days before they take effect. Other changes apply as of the “Last updated” date. Where required by law, changes may take effect immediately.
24. Termination
We may, without notice, terminate or restrict your access to the Site at any time, in addition to other legal remedies. We may also temporarily or permanently shut down the Site/parts of it, delete information/Content, and make changes without liability for any resulting data loss. Sections on IP, disclaimers, limitation of liability, indemnity, and other provisions that by their nature should survive, will survive termination.
